I was happy with his presentation during our initial meeting and so I decided to pay the full retainer he requested up front, before receiving any services. Mr. Cavanaugh sent me an information packet to fill out, and I informed him that I needed time to make a decision.\n\nFortunately, after several weeks of negotiating on my own with creditors, I was able to work out an alternative path to bankruptcy.\n\nUnfortunately, despite not having provided any services, Mr. Cavanaugh refused to refund any portion of my retainer, relying on a clause in his contract that classifies the \"retainer\" as a non-refundable fee. Never in my life have I dealt with a business that has non-refundable retainers.\n\nNeedless to say, I cannot recommend him. He used my law firm's reputation to negotiate settlements with his creditors outside my representation. After deriving this benefit at my cost, he asked for a full refund. He certainly had a chance to review the contract, and I in no way treated him poorly.<br>Unfortunately, it is common for creditors to try to negotiate settlements when threatened by bankruptcy. When an attorney is hired, this makes it real for them. Obviously, they will do this despite the presence of an existing attorney-client relationship. I had several initial consultations before visiting Cavanaugh (who met me in person), and this was the only one which was actually helpful.
