I know your mother’s death will remain in your mind for the rest of your life. I remembered you but had to pull the file that we opened for you in 2010 and closed in 2011, because we could not find an expert who would link medical negligence as the cause of your mother’s death. In doing our due diligence, we associated counsel with expertise in nursing home cases, hired a nurse who opined no causation, and then, even when it is our office policy to close a case once an expert has so advised, we took the extra step of hiring a doctor to review the records once again; the doctor also opined no causation. In my experience, causation usually is what is missing for a successful nursing home case. There’s often negligence, but proving negligence is what caused your mother’s death was why we couldn’t ethically take the case any further.
