When I came in for a consultation the attorney promised me that they would find a different way to serve him. But it turned out that this attorney did the same thing that I had already done. He hired private servers that could never find the thief, so nothing have moved on. Because they could not do anything that I had not done it myself so I am exactly at the same juridic place that I was one year ago. Except that I am short around 7 thousand more, because that is what I paid this law office for them to do nothing. We understand how upsetting it is to be the victim of theft, and even more upsetting when the legal process does not move as quickly as you hoped.
We would like to clarify a few important points that may help explain what has occurred. Under the Rules of Civil Procedure, a defendant must be properly served before a case can move forward. Proper service is not optional, it is a legal requirement. If service is not completed correctly, any judgment obtained can later be overturned, which could cause even greater delay and expense. For that reason, we must follow the rules carefully and precisely.
Unfortunately, when a defendant actively avoids service, such as refusing to answer the door or intentionally hiding, that is outside of our control. Evasive defendants often require multiple documented attempts by licensed process servers before alternative methods of service can even be requested from the court. Courts require proof of diligent efforts before authorizing substitute service, and that process can take time.
Hiring professional process servers was not “doing nothing”, it was a necessary legal step to build the record required by the court. Even when the attempts are unsuccessful, they are often critical in laying the groundwork for requesting alternative service methods.
We also want to respectfully address the suggestion that individuals should handle legal matters on their own. While people certainly have the right to represent themselves, civil procedure is highly technical. Missing a procedural step, serving improperly, or moving forward without court authorization can jeopardize a case entirely. Our role is to ensure the matter is handled correctly so that your rights are protected and any judgment obtained is enforceable.
